Malaysia Arbitration and Arbitration Center (APIAC) Successfully Concludes Its First Arbitration Case……

In January 2025, the Asia Pacific International Arbitration Chamber (Malaysia) (hereinafter “APIAC (Malaysia)”) successfully concluded its first arbitration case, achieving a series of notable results.

First, the case used APIAC’s pioneering “Arbitration by Invitation + Mediation” mechanism, providing an efficient solution to a dispute where the contracting parties had not expressly included an arbitration clause in their contract.

Second, the case fully demonstrated APIAC (Malaysia)’s multilingual strengths. The claimant was a Malaysian company with Chinese capital, while the respondent was a Malaysian citizen. With the assistance of the APIAC (Malaysia) Secretariat, the parties conducted mediation in multiple languages, including Chinese, Malay and English, and ultimately reached a settlement. This cross-cultural, multilingual approach to mediation played a key role in facilitating effective communication and securing the settlement agreement.

Third, arbitration fees in this case were fixed according to the amount in dispute, significantly reducing the parties’ financial burden. This model offers businesses a more cost-effective approach to dispute resolution.

Finally, the consent award in this case was issued by 拿督蒋胜帆, an Arbitrator of the Malaysia International Arbitration Center (APIAC), ensuring that the agreement reached following mediation was legally binding on both parties and would be promptly enforced.

The Malaysia International Arbitration Center (APIAC)’s “Arbitration by Invitation + Mediation” mechanism offers distinctive advantages in professionalism, cost-effectiveness and efficiency. Through APIAC’s “Arbitration by Invitation + Mediation” model, businesses can resolve disputes quickly and effectively, ensuring smooth subsequent business cooperation.
