First Mainland Property Preservation Successfully Obtained Following the Inclusion of the Hong Kong Arbitration Center of the Asia Pacific International Arbitration Chamber in the Interim Measures Arrangement

On April 2, 2025, the Department of Justice of the Government of the Hong Kong Special Administrative Region published the announcement of the results of applications for confirmation of eligibility under Article 2(1) of the Supreme People’s Court Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region (Judicial Interpretation [2019] No. 14), formally confirming the inclusion of the Hong Kong Arbitration Center of the Asia Pacific International Arbitration Chamber APIAC-HKAC) in the latest list of arbitration institutions eligible under the Arrangement. The list was submitted by the Hong Kong SAR Government and reviewed and confirmed by the Supreme People’s Court.
Under the Arrangement, parties to arbitral proceedings seated in Hong Kong and administered by the Hong Kong Arbitration Center of the Asia Pacific International Arbitration Chamber (APIAC-HKAC) may apply to Mainland courts for property preservation, evidence preservation and conduct preservation measures.
Notably, APIAC-HKAC has already handled a practical case under this Arrangement: an application for property preservation in an arbitration administered by APIAC-HKAC was submitted to a Shanghai court. The case was filed on December 3, and the court issued its ruling on December 10, completing the entire review procedure within 7 days. The case demonstrates the Mainland courts’ effective implementation of the Arrangement and highlights APIAC-HKAC’s advantages in cross-border dispute resolution.
