How can parties in different countries apply for international arbitration?

Answer

The seat of arbitration is a legal connecting factor that plays an important role in facilitating the orderly conduct of international commercial arbitration and the effective resolution of international commercial disputes. The cross-regional nature of arbitration, the international character of the international commercial arbitration system, and innovations in information technology together determine arbitration institutions’ ability to provide services across jurisdictions. Parties may file an application under the arbitration rules and procedures specified in their arbitration agreement, regardless of where they are located.

How are arbitration fees calculated and paid?

Answer

Arbitration fees generally include tribunal fees, institutional administration fees, and hearing fees. Fees are calculated based on the amount in dispute, the complexity of the case, and the arbitration procedure selected. Parties usually need to pay the relevant fees in advance when filing an arbitration application; the tribunal determines the final allocation of costs in its award. We provide an online fee calculator to help parties estimate costs.

How long do arbitration proceedings take?

Answer

The duration of arbitration depends on the complexity of the case, the parties’ cooperation, and the type of procedure selected. Generally, expedited proceedings can be completed within 3-6 months, while ordinary proceedings usually take 6-18 months. Emergency arbitration may yield a preliminary decision within a few weeks. We are committed to handling cases efficiently while ensuring procedural fairness.

How are arbitrators selected?

Answer

Parties may select arbitrators under the procedures specified in the arbitration rules. Usually, each party selects one arbitrator, and those two arbitrators jointly select the presiding arbitrator. If the parties fail to agree within the prescribed period, the appointing authority will make the appointment. We maintain a roster of arbitrators with expertise in various fields.

How should an arbitration agreement be drafted?

Answer

A valid arbitration agreement should clearly specify arbitration as the dispute resolution method, the arbitration institution, the applicable arbitration rules, the place of arbitration, and the language of arbitration. We recommend using a standard arbitration clause template and adapting it as appropriate to the circumstances. The clause should be clear and unambiguous so that arbitration can commence smoothly if a dispute arises.

Is an arbitral award legally binding?

Answer

An arbitral award is legally binding once issued, and the parties should comply voluntarily. If the losing party does not comply voluntarily, the prevailing party may apply to a court with jurisdiction for enforcement. Under international treaties such as the New York Convention, arbitral awards are widely recognized and enforced worldwide, which is one of arbitration’s important advantages over litigation.
